Contract Breaches

Right 2 Manage cover lease covenant enforcement so that as many new owners as possible are aware of their obligations under the lease. However, if necessary, Right 2 Manage will take more stringent measures to ensure that covenants are complied with, and always where illegal or dangerous acts are involved.

Typically, parking and noise tend to be the most common problems in a communal living environment like a block of flats. It is essential that residents respect each other and treat each other how they would like to be treated.

It is essential that flat or property owners abide by the terms of their lease. Where requested, we will take action against persistent abusers including legal action if the problem persists. The correct disposal of refuse is also an important issue with flat and property owners, especially with today’s need for recycling and reducing waste as well as costs.

Shorthold Tenancies and Tenants

Flat or Property owners who let their properties out on shorthold tenancies are responsible for the actions of their tenants. Any breaches by their tenants will result in enforcement action against the Flat or Property owner.

To avoid conflict, we advise property owners to vet their tenants carefully and ensure that both they and their prospective tenants are aware of the terms of the lease. Most leases and/or insurers require letting to be to professional (working) family unit on an Assured Short Hold Tenancy. We advise owners to check with us to ensure that their prospective tenant is acceptable under the terms of the block insurance policy, which provides cover for the whole building or block, including their property.

For security, fire safety and insurance purposes, Right 2 Manage request that all lettings are registered as soon as possible. It is essential that we advise insurers as soon as any property is vacant or going to be left unoccupied in order for the insurance cover can be maintained.
